IMPORTANT INFORMATION NO WARRANTY: All sales are made "as is" without warranty of any nature and specifically with regard to the physical condition, acreage, suitability, zoning or validity of title to the property. A prospective purchaser is advised to contact his or her attorney before the sale regarding the rights of a purchaser at a judicial sale. The Court and the Commissioner make no warranties regarding the property whatsoever. It is strongly recommended that if you purchase property at a sale you seek the advice of your attorney immediately regarding a title examination. Any objections to the sale must be made prior to confirmation of the sale. Confirmation usually takes place ten (10) days after the filing of the report of sale which usually is filed the day of the sale. CANCELLATIONS: Any sale may be cancelled without notice. REQUIREMENTS FOR BIDDING: The requirements for purchase are noted in each advertisement. All bidders must be prepared to comply with the purchase requirements prior to bidding. If you are required to post a "surety bond" for the balance of the purchase price you must have someone at the sale who has property which has equity exceeding the amount of the bond to sign the bond and guarantee the payment of the balance of the price. The unpaid purchase price accrues interest at 12% from the date of the sale until paid. TIME OF SALE: All times stated in the notices refer to CENTRAL time. DISCLAIMER: The Court, Commissioner and parties to the proceedings are not legally bound by the advertisement or this web site and the contents of the court judgment and order of sale control. The information contained on this site is strictly for the convenience of prospective purchasers. Any information regarding these properties, and specifically pertaining to the square footage, layout, condition, or valuation of these properties is taken from public records available at the Barren County Property Valuation Office and we do not warrant the accuracy of any of this information. INSPECTION: Unless noted in the advertisement, the interior of the property is not available for inspection prior to sale. We are unable to show the properties. APPRAISALS AND RIGHT OF REDEMPTION: In most sales, the court appoints appraisers to value the property. Kentucky law requires that if the property does not bring 2/3'rds of the appraised value, the owners have 1 year to buy the property back at the sale price. This is called the debtors' right of redemption. OPENING BIDS: Sometimes the foreclosing lender will make an opening bid before the sale. We attempt to post all such bids on this page. Sales where an opening bid is stated will begin at that price. LOCATION OF SALES: Due to the street noise, the sales are usually moved to a courtroom inside the building. When you arrive at the justice center ask the security staff just inside the entry doors about the location. |
